1. Interpretation and Definitions

Definitions

• “Company”, “we”, “our”, or “us” refers to Volodymyr Koniukh operating under Polish sole proprietorship (JDG).
• “Service” refers to the Lucently application or website.
• “User”, “you”, or “your” refers to any individual using the Service.
• “AI Responses” refer to automatically generated messages based on your inputs using OpenAI's API and a custom prompt.
• “Insight Feature” refers to the reflection mechanism that algorithmically analyzes a sequence of inputs to surface patterns or reframe meaning.

2. Acknowledgment & Acceptance

These Terms govern the use of Lucently. By accessing or using the Service, you agree to comply with them. If you disagree with any part of these Terms, you may not use the Service.

3. Nature of the Service

Lucently is an AI-powered self-reflection tool that allows users to explore their thoughts through conversation with a language model.

The responses are entirely AI-generated and are not reviewed by humans.

Lucently provides semantic suggestions, perspective shifts, and insightful reframing, but does not provide factual guarantees, medical insight, or psychological analysis.

4. No Psychological or Therapeutic Advice

Lucently is not a medical device, not a diagnostic platform, and not a substitute for therapy.

It does not provide:

• professional mental health support,
• clinical assessment,
• emergency assistance.

If you are in distress or need help, please contact a licensed professional or crisis service.  

Lucently is not intended for use by individuals in acute mental health crisis or those at risk of harm. If you or someone you know is in distress, please seek immediate help from a licensed professional or crisis service.

5. Eligibility

You must be at least 18 years old to use this Service. We do not knowingly collect data from individuals under 18.By using the Service, you confirm that you meet the age requirement. We may implement reasonable technical checks (e.g., device age settings, platform-based controls) to assist in age verification, where applicable.

6. User Responsibilities

You agree not to use the Service to:

• Request, input, or promote harmful, abusive, violent, or illegal content.
• Use AI outputs as a replacement for critical personal, medical, legal, or professional decisions.
• Attempt to hack, reverse engineer, or misuse the Service or its underlying technologies.

7. Data and Privacy

Use of the Service is subject to our Privacy Policy, which describes:

• What data we collect,
• How it’s used (e.g., for AI reply generation),
• Your rights (access, export, deletion).

Lucently does not knowingly collect data from users under 18.

Your inputs and AI responses may be temporarily processed by OpenAI's API, subject to their terms.

8. Ownership & Intellectual Property

All visual design, branding, and proprietary prompt logic belong to the Company.

You retain ownership over your content but grant us a license to process it solely for providing the Service.

9. Termination

We reserve the right to terminate or restrict your access to Lucently at any time for violations of these Terms or applicable law.

10. Disclaimer – “AS IS” and “AS AVAILABLE”

Lucently is provided on an “AS IS” and “AS AVAILABLE” basis.

We do not guarantee:

• that the Service will be uninterrupted or error-free,
• that responses will be factually accurate, psychologically safe, or contextually suitable,
• that AI-generated content will not contain unintended or biased outputs.

Use of the Service is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Lucently and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, emotional distress, or reputational harm, even if advised of the possibility.
In no event shall our total liability exceed the greater of: (a) the amount paid by you for the Service in the last 12 months, or (b) €100.
Nothing in these Terms limits liability in cases where such limitation is prohibited by law, including liability for death, personal injury, or willful misconduct.

12. Governing Law

These Terms shall be governed by the laws of the Republic of Poland. However, for users located outside the European Union, additional contractual provisions may be interpreted under generally accepted principles of international private law, provided they do not conflict with mandatory consumer protection laws in the user’s country of residence.

13. Force Majeure

We shall not be held liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, war, acts of government, disruptions to internet infrastructure, or failures of third-party providers.

14. Dispute Resolution

If you have any concern, please contact us first. We will attempt to resolve disputes informally before engaging legal remedies.

15. Modifications to Terms

We may update these Terms at any time. If changes are material, we will notify you. Continued use of the Service after changes indicates acceptance of the new Terms.

17. Subscriptions and Payments

Lucently offers two service tiers: a Free plan and a Paid plan ("Lucently Plus"). Each tier includes specific usage limits and access levels.

18. Third-Party Platforms

Lucently may be accessed through third-party platforms such as the Apple App Store or Google Play.

Your use of the Service through these platforms is also governed by their respective terms and policies. We are not responsible for billing, availability, or platform-specific limitations related to these services.

19. Subscription Processing via RevenueCat

Lucently uses RevenueCat to manage and validate subscription status and in-app purchases. RevenueCat acts as a technical intermediary between the Service and app store platforms.

We do not store payment details; all financial transactions are processed securely through the respective platform’s billing system (Apple or Google).

20. AI Content and OpenAI Integration

Lucently relies on OpenAI’s API to generate AI-based responses. By using the Service, you acknowledge that:

• Content is generated algorithmically by a third-party provider (OpenAI), whose systems are not controlled or reviewed by us.
• We act solely as a technical intermediary and are not the author, editor, or controller of AI-generated content.
• All AI outputs are provided “as is,” without guarantees of factual accuracy, psychological safety, or contextual suitability.
• OpenAI’s content policy and terms apply to all generated content.
  Responsibility for interpreting and acting on AI responses lies solely with the user.

Free Plan

The Free plan includes limited access to the Service:

• Up to approximately 25 standard messages per day (measured by internal token usage)
• Up to 3 Insight Cards per day
• Up to 2 Action items per day
• No access to full text of Insight Cards, semantic statistics, or aggregated trend views

Usage is internally tracked using tokens (units used to process and generate AI responses). For transparency, we approximate one standard message as up to 300 tokens, depending on message length and complexity.

We reserve the right to adjust token limits or equivalencies to maintain system balance and user fairness.

Paid Plan (Lucently Plus)

Lucently plus is offered as a monthly or annual subscription and includes:

• Increased usage limits:
  • Up to approximately 200 standard messages per day
  • Up to 20 Insight Cards per day
  • Up to 10 Action items per day
• Full access to:
  • Insight Card full text and context
  • Semantic statistics, aggregated views, and trend analysis
  • Experimental and advanced features as they become available

Billing and Cancellation

Paid subscriptions are processed via the platform through which the user accesses the Service (e.g., Apple App Store, Google Play). The following terms apply:

• Automatic renewal: Subscriptions automatically renew unless canceled at least 24 hours prior to the end of the current billing period.
• Cancellation: Users can manage or cancel their subscription at any time through their respective app store account settings.
• No refunds: Payments are final and non-refundable, except where required by applicable law. No refunds are given for partial usage or unused time.

By purchasing a Lucently Plus subscription, you agree to these terms and acknowledge that enhanced access is contingent upon an active paid plan.

Notes on Token-to-Message Conversion

Lucently internally uses OpenAI-compatible token accounting to measure usage. While actual token usage may vary based on language, message length, and content structure, we estimate:

• 1 standard message = up to 300 tokens
• Insight Cards and Actions may involve additional token costs depending on output length and processing logic

These approximations are provided for user clarity and may be adjusted to reflect actual backend computation patterns without prior notice.

Lucently is designed to support personal reflection, not to provide any form of professional or clinical advice.The Service and its AI responses are informational and exploratory in nature and should never be relied upon as a substitute for professional judgment.Use the Service with awareness that any actions or decisions remain your sole responsibility.
